Contract

The Lessor agrees to rent the following vehicle to the Renter (Car model, license plate and fuel type).

By signing this Agreement, the Renter confirms that they have read, understood, and accepted all terms and conditions stated below.

1. Vehicle Use

• The Renter agrees to use the vehicle exclusively for lawful purposes.
• The Renter must comply with all Spanish traffic laws and regulations.
• The vehicle must not be used for racing, towing, competitions, off-road driving, sub-renting, commercial transport (unless expressly agreed), or illegal activities.
• No unauthorized driver may operate the vehicle.
• The driver must hold a valid driving licence legally recognised in Spain.

Any breach of these conditions results in full financial liability, regardless of the selected protection option.

2. Insurance, Liability & Accident Excess

The Renter is financially responsible for any loss, theft, damage, fines, penalties, or misuse occurring during the rental period.

In the event of an accident:

• The Renter must notify the Lessor immediately.
• A police report must be obtained when legally required.
• A completed accident report must be provided.
• Failure to comply may result in full liability.

The Renter must select one of the following Accident Excess options:

2.1 No Extra Protection

In case of accidental collision damage, the Renter is fully liable up to the total market value of the vehicle.

2.2 Basic Protection

In case of accidental collision damage, the Renter’s liability is limited to an accident excess of €1,500 per incident.

2.3 Premium Protection

In case of accidental collision damage, the Renter’s liability is limited to an accident excess of €300 per incident.

2.4 Full Protection

No accident excess applies for accidental collision damage.

However, Full Protection does NOT apply in cases of:

• Negligence or reckless driving
• Driving under the influence of alcohol or drugs
• Misuse or prohibited use
• Unauthorized driver
• Breach of contract terms
• Failure to provide required documentation after an accident

In such cases, the Renter remains fully liable.

3. Security Deposit

A refundable security deposit is required at the start of the rental. The exact deposit amount depends on the vehicle category selected.

The deposit may be retained partially or fully to cover:

• Damage not covered by the selected protection
• Missing fuel
• Excess mileage
• Traffic fines
• Cleaning costs beyond normal wear and tear
• Lost keys
• Incorrect fuel usage

If total costs exceed the deposit amount, the Renter authorizes the Lessor to charge the remaining balance.

The deposit will be refunded after inspection of the vehicle, provided no additional charges apply.

4. Mileage & Additional Charges

• Mileage limit: 100 km per day unless otherwise agreed.
• Additional kilometres are charged at €0.10 per km.
• Late return will be charged at the applicable daily rental rate and may result in cancellation of future reservations.

5. Vehicle Condition & Return

The vehicle is delivered in good mechanical and visual condition.

• The Renter must return the vehicle in the same condition, except for normal wear and tear.
• The vehicle must be returned with the same fuel level as delivered.
• The Lessor may inspect the vehicle upon return.

The Lessor may document the vehicle condition using photographs or video at pick-up and return.

All vehicles are equipped with GPS systems for mileage monitoring, theft prevention, fine management, and recovery in case of non-return. Tampering with tracking systems results in full liability.

6. Early Termination

The Lessor may terminate this agreement immediately if:

• The vehicle is misused,
• Payment is incomplete,
• The Renter breaches any contract term.

The Renter must immediately return the vehicle upon termination. No refund is guaranteed in case of breach.

7. Governing Law

This Agreement is governed by Spanish law and subject to the jurisdiction of the courts of Alicante.
